An unresolved tax balance can become much harder to manage when it is left unattended. In this Notes From The Executive extract, hosted by Mina Amso, Dave Ananth discusses the effect of allowing tax debt to accumulate instead of confronting the underlying problem. The message is about timing and engagement, rather than a particular debt figure.
Interest and penalties can increase the amount outstanding while the original liability remains unresolved. If the position continues for years, a once-manageable problem may develop into serious enforcement or an insolvency matter. The amount shown on a statement is only one part of the assessment: business cashflow, ongoing obligations and the stage of Inland Revenue’s response also matter.
Business owners should not wait for a statutory demand, liquidation proceeding or final enforcement notice before obtaining accounting and legal advice. Earlier engagement gives advisers an opportunity to establish the facts and consider what information is needed. It does not guarantee that a particular option remains available, that enforcement will pause, or that IRD will reduce the balance.
Dave is a Partner at Meridian Partners and works in student loans, tax disputes and negotiations with Inland Revenue. A practical review may require the accountant’s reconstruction of the financial position alongside advice about the tax matter. Sustainable proposals need to reflect what can actually be done, including how current obligations will be met. Inland Revenue retains responsibility for deciding whether any proposed arrangement is acceptable, and past results do not predict the outcome of another case.
Practical points
- Check the liability, interest and penalties rather than ignoring statements.
- Identify any enforcement notices and response deadlines.
- Obtain accounting and legal advice before the matter becomes urgent.
- Base any proposal on realistic finances and ongoing compliance.
